Most states refer to driving under the influence as a DUI. In Texas, it is more commonly known as DWI, which stands for driving while intoxicated. The terms are interchangeable and generally mean the same thing. In order to be charged, a police officer must have pulled you over due to reasonable suspicion. Then, your blood alcohol content (BAC) must be at .08 or higher. That being said, even if your BAC is not above the legal limit, you can still be charged. An officer can allege that your mental and physical abilities were impaired enough that you could not safely operate a vehicle.

If you are being accused of drunk driving, don’t panic. In many cases, I have been able to negotiate the consequences down for my clients. If convicted, though, you are looking at serious consequences. If it is your first offense, you are looking at a $2,000 fine, 180 days in jail and a license suspension of up to one year. If it is your second or third offense, it can jump up to a $10,000 fine, 10 years in prison and a two-year license suspension. I take these charges seriously and know how to handle them.
